PEARLBAY® offers a wide range of products and services and services, including education, retail, music production. References to PEARLBAY® products and services in this statement include PEARLBAY® services, websites, apps, software, servers, and devices. This privacy statement applies to all PEARLBAY® entities including Pearbay Holdings, Pearlbay Institute, Pearlbay Music, myPearlbay App and Pearlbay Leisure, and PEARLBAY® is the registered trademark and trading name of all its subsidiaries.

Personal data we collect

PEARLBAY® collects data from you, through our interactions with you and through our products and services. You provide some of this data directly, and we get some of it by collecting data about your interactions, use, and experiences with our products and services. The data we collect depends on the context of your interactions with PEARLBAY® and the choices you make, including your privacy settings and the products and services and features you use. We also may obtain data about you from third parties.
If you represent an organisation, such as a business or service provider, that utilises Products and services from PEARLBAY®, this policy also applies to you his privacy statement to learn how we process your data.
You have choices when it comes to the technology and facilities you use and the data you share. When we ask you to provide personal data, you can decline. Many of our products and services require some personal data to provide you with a service. If you choose not to provide data required to provide you with a product or feature, you cannot use that product or feature or the services we offer. Likewise, where we need to collect personal data by law or to enter into or carry out a contract with you, and you do not provide the data, we will not be able to enter into the contract.

How we use personal data

PEARLBAY® uses the data we collect to provide you with rich, interactive experiences. In particular, we use data to:
Provide our products and services, which includes updates as well as providing support. It also includes sharing data, when it is required to provide the service or carry out the transactions you request.
Improve and develop our products and services.
Personalise our products and services and make recommendations.
Advertise and market to you, which includes sending promotional communications, targeting advertising, and presenting you with relevant offers.
We also use the data to operate our business, which includes analysing our performance, meeting our legal obligations, developing our workforce, and doing research.
In carrying out these purposes, we combine data we collect from different contexts (for example, from your use of two PEARLBAY® products and services) or obtain from third parties to give you a more seamless, consistent, and personalised experience, to make informed business decisions, and for other legitimate purposes.
Our processing of personal data for these purposes includes both automated and manual (human) methods of processing. Our automated methods often are related to and supported by our manual methods. For example, our automated methods include artificial intelligence (AI) data gathered through other third parties such as Facebook, Instagram, Twitter etc which we think of as a set of technologies that enable us to perceive, learn, reason, and assist in decision-making to solve problems. To build, train, and improve the accuracy of our automated methods of processing (including AI), we manually review some of the predictions and inferences produced by the automated methods against the underlying data from which the predictions and inferences were made. This manual review may be conducted by PEARLBAY® employees or vendors who are working on PEARLBAY®’s behalf.

Reasons we share personal data

We share your personal data with your consent or to complete any transaction or provide any product you have requested or authorised. We also share data with PEARLBAY®-controlled affiliates and subsidiaries; with vendors working on our behalf; when required by law or to respond to legal process; to protect our customers; to protect lives; to maintain the security of our products and services, and to protect the rights and property of PEARLBAY® and its customers.

You can also make choices about the collection and use of your data by PEARLBAY®. You can control the personal data that PEARLBAY® has obtained, and exercise your data protection rights, by contacting PEARLBAY® or using various tools we provide. Products and services provided by our organisation—notice to end-users

If you use a PEARLBAY® product or services provided by an organisation or a third party you are affiliated with, such as your work, school or other entity, that organisation can collect and hold your personal data as per their privacy policy. However, PEARLBAY® is not responsible for the privacy or security practices of our customers, which may differ from those outlined in this privacy statement.
When you use a PEARLBAY® product or services provided by your organisation, PEARLBAY®’s processing of your personal data in connection with that product is governed by a contract between PEARLBAY® and your organisation. PEARLBAY® processes your personal data to provide the product to your organisation and you, and in some cases for PEARLBAY®’s legitimate business operations related to providing the product and services. As mentioned above, if you have questions about PEARLBAY®’s processing of your personal data in connection with providing products and services to your organisation, please contact your organisation or our affiliates at the first instant.
For PEARLBAY® products and services provided by our Pearlbay Institute, including the myPEARLBAY® app, PEARLBAY® will:
not collect or use student personal data beyond that needed for authorised educational or school purposes;
not sell or rent student personal data;
not use or share student personal data for advertising or similar commercial purposes, such as behavioural targeting of advertisements to students;
not build a personal profile of a student, other than for supporting authorised educational or school purposes or as authorised by the parent, guardian, or student of appropriate age; and
require that our vendors with whom student personal data is shared to deliver the educational service, if any, are obligated to implement these same commitments for student personal data.
PEARLBAY® account

With a PEARLBAY® account including my Pearlbay App and Student Portal, you can sign in to PEARLBAY® products and services, as well as those of select PEARLBAY® partners. Personal data associated with your PEARLBAY® account includes credentials, name and contact data, payment data, device and usage data, your contacts, information about your activities, and your interests and favourites. Signing in to your PEARLBAY® account enables personalisation and consistent experiences across products, services and devices, permits you to use cloud data storage, allows you to make payments using payment instruments stored in your PEARLBAY® account, and enables other features.
There is only one type of PEARLBAY® account:
When you create your PEARLBAY® account tied to your personal email address, we refer to that account as a personal PEARLBAY® account.

Collection of data from children

When a PEARLBAY® product collects age, and there is an age in your jurisdiction under which parental consent or authorisation is required to use the product, the product will either block users under that age or will ask them to provide consent or authorisation from a parent or guardian before they can use it. We will not knowingly ask children under that age to provide more data than is required to provide for the product and services
Once parental consent or authorisation is granted, the child’s account is treated much like any other account. The child can access services freely like other users of all ages. 
Parents or guardians can change or revoke the consent choices previously made, and review, edit or request the deletion of the personal data of the minors for whom they provided consent or authorisation. The parent or guardian can manage a child’s information and settings on our app and view and delete or request to delete a child’s data on our platform

myPearlbay is an app offered to our customers to access and engage with our product and services under one place. While we have standardised our operations and our app comply with universal standards, we do not accept any responsibility of
Damage or loss of data caused by installing our app
Any loss of data including myPearlbay points due to gross negligence or tampering.
Physical or mental harm due to the use of the app such as while driving or performing other acts including purchasing or searching Pearlbay products or services.
We have taken all recommended protection against data piracy and theft such as web security and virus guard. However, we cannot guarantee any responsibility for loss and or theft of data due to factors beyond our control including failures of third parties services such as virus guard providers.
General
When a customer tries, purchases, uses, or subscribes to PEARLBAY® products and services, or obtains support for or professional services with such products and services, PEARLBAY® receives data from you and collects and generates data to provide the service (including improving, securing, and updating the service), conduct our legitimate business operations, and communicate with the customer. For example:
When a customer engages with a PEARLBAY® sales representative, we collect the customer’s name and contact data, along with information about the customer’s organisation, to support that engagement.
When a customer interacts with a PEARLBAY® support professional, we collect device and usage data or error reports to diagnose and resolve problems.
When a customer pays for products and services, we collect contact and payment data to process the payment.
When PEARLBAY® sends communications to a customer, we use data to personalise the content of the communication.
When a customer engages with PEARLBAY® for professional services, we collect the name and contact data of the customer’s designated point of contact and use the information provided by the customer to perform the services that the customer has requested.

How we secure your and our data?
We use strong and reputed software companies to safeguard our database from pirates and scammers and hackers.
We train our staff on data protection and how to safeguard sensitive data.
Our database is encrypted and has controlled access.
We do not disclose your personal data without your consent unless the law required us to do so.
How long do we keep your data?
We keep your data in a secure database as long as you need up to keep them with us.
You can inform us to delete your data at any time, but we may not be able to provide you with the same level of service if you chose this option.
If you stop using our products or services or your account becomes dormant for 24 months, we will delete your account automatically including all personal data from our database. This may delete your myPearlbay points collected over time and these cannot be reinstated if you do decide to restart your account with us.
